These Terms of Service apply when you visit or purchase from theodoremensjewellery.com or otherwise use services offered by Theodore Men’s Jewellery (“TMJ”, “we”, “us” or “our”). By using the site or placing an order, you agree to these terms and the policies linked from them.

1. Eligibility and acceptable use

You must be legally capable of entering into a contract, or use the site with the involvement of a parent or guardian. You must not use the site for an unlawful purpose, interfere with its security or operation, introduce malicious code, scrape or copy content without permission, or infringe another person’s rights.

2. Product information

We aim to present product descriptions, dimensions, materials, colours and images accurately. Natural materials and handmade or hand-finished items may have minor variations. Screen settings can also affect colour. These variations are not necessarily faults, but your rights under the Australian Consumer Law remain unaffected.

Product availability and prices may change without notice. We may limit quantities where reasonably necessary.

3. Orders

An order is an offer to purchase. We may accept or decline an order, including where an item is unavailable, information is incorrect, payment is not authorised, or fraud is suspected. A confirmation email acknowledges receipt; a contract is formed when we accept and begin processing the order. If we cannot accept an order after payment, we will refund the affected amount.

You are responsible for ensuring the contact, billing and delivery information supplied is accurate. Contact us promptly if you identify an error.

4. Prices and payment

Prices are shown in the currency selected on the site. Unless stated otherwise, Australian prices include GST where applicable. Delivery charges, duties and taxes are shown or described at checkout where available. Payments are processed by Shopify and the payment provider selected at checkout. Buy-now-pay-later services are subject to the provider’s eligibility criteria and terms.

5. Shipping

Processing, shipping rates, tracking, delivery estimates, international duties and collection options are described in our Shipping Policy. Delivery estimates are not guarantees where delays are outside our reasonable control.

6. Returns, refunds and consumer guarantees

Our voluntary change-of-mind terms and the process for faulty, damaged or incorrect items are set out in our Refund Policy.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

7. Accounts

If you create an account, you are responsible for keeping your sign-in details confidential and for activity under your account. Tell us promptly if you suspect unauthorised access. We may suspend access where reasonably necessary to protect you, us or the site.

8. Promotions and gift cards

Promotions may be subject to additional terms, dates, eligibility requirements and stock limits shown with the offer. Unless stated otherwise, offers cannot be combined. Gift cards are subject to the terms displayed when purchased and any applicable law.

9. Intellectual property

The site and its content, including branding, text, graphics, photography, layout and software, are owned by or licensed to TMJ and are protected by intellectual-property laws. You may view and use the site for personal shopping. No other use is permitted without prior written consent.

10. Reviews and user content

If you submit a review, image or other content, you confirm that it is accurate, lawful and yours to share. You give us a non-exclusive licence to display and use that content in connection with our business. We may moderate or remove content that is unlawful, misleading, abusive, irrelevant or infringes rights.

11. Third-party services and links

The site may use or link to services operated by third parties, including payment, delivery, social-media and buy-now-pay-later providers. Their separate terms and policies apply when you use those services. We are not responsible for third-party services to the extent permitted by law.

12. Privacy

Our collection and handling of personal information is described in our Privacy Policy.

13. Site availability and liability

We aim to keep the site accurate, secure and available, but it may occasionally be interrupted or contain errors. To the extent permitted by law, we are not liable for losses that are indirect, unforeseeable or caused by matters outside our reasonable control. Nothing in this section limits liability or remedies that cannot lawfully be limited.

14. Changes and severability

We may update the site and these terms. The current version and update date will appear on this page. If a provision is invalid or unenforceable, the remaining provisions continue to apply.

15. Governing law

These terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of courts with authority in Victoria. This does not prevent you from exercising rights available under another applicable law.
